CONTENT PROPERTY OWNERSHIP
Except as expressly provided in these Terms and Conditions, nothing
contained herein shall be construed as conferring any license or right, by
implication, or otherwise, under copyright or other intellectual
property rights. All intellectual property rights in the contents of the
Site, including but not limited to publications, graphics, blogs, and all
other property on the Site (collectively, the "Content"), are owned by Planetrum or its licensors. Our rights to the Content are protected by
national and international copyright, trademark, and other intellectual
property laws and treaties. The extent of your license to use the Content on
the Site is limited to your own personal use. Your commercial use of the
Content is strictly prohibited. We reserve the right to revoke your license
and terminate your access rights to the Site with or without notice to you
at any time for any reason, including but not limited to your express
violation of the limited license provided to you.
LICENSE OF YOUR CONTENT TO PLANETRUM
By posting, publishing, uploading, or distributing any messages, data, information, text graphics, photos, links, content, or other materials (collectively, the "Postings")
for use on this Site, you grant (or warrant that the owner of such rights
has expressly granted) Planetrum and its affiliates an irrevocable,
royalty-free, non-exclusive license to use, reproduce, publish, and publicly
display the Postings in any form, medium, or technology now known or later
developed. You agree that you shall have no recourse against Planetrum for
any alleged or actual infringement or misappropriation of any proprietary
right in the Postings you provide to Planetrum. You also warrant that any
"moral rights" in posted materials have been waived, and that you are not
entitled to any compensation for such use.
LINKING TO OUR SITE
If you link to the Site you agree not to: (1) remove or obscure, by framing
or otherwise, any portion of the homepage, including but not limited to thee Privacy Policy; (2) imply that the Site or
Planetrum is endorsing you or your products and services; (3) imply an
affiliation between you and the Site or Planetrum without our prior
written consent; (4) present false or misleading impressions about our
products and services; or (5) link to materials that may be interpreted as
distasteful or offensive.
In establishing links, you must not represent in any way, expressly or
implicitly, that you have received the endorsement, sponsorship or support
of the Site. You agree to remove any links you have to the Site upon our
request.
PASSWORDS
You are responsible for maintaining the confidentiality of your User ID and password, if any. You agree to notify us as soon as you discover any
unauthorized use of your password. Your password is key to your account. You should never share it with anyone and we request that you change it periodically and often. If you have questions regarding this or need assistance changing your password please contact us. We strongly urge you to sign off of your account and close your browser window when you have finished your shopping to prevent someone else from accessing your account.
UNLAWFUL ACTIVITY
Planetrum reserves the right to investigate complaints or reported
violations of our Terms and Conditions and to take any action we deem
appropriate including but not limited to reporting any suspected unlawful
activity to law enforcement officials, regulators, or other third parties,
and disclosing any information necessary to appropriate persons or entities
relating to user profiles, e-mail addresses, usage history, posted
materials, IP addresses and traffic information.

Confirming an order made on the Planetrum website by an Internet user (clicking on the "Proceed" button) implies full and complete acceptance of all the present general sales conditions.
This contract is drawn up in accordance with French law. Full competence corresponds to the courts of the jurisdiction in which the Planetrum official headquarters are based (Pointe à Pitre – French West Indies).
• ARTICLE 2 : ORDERING
Once the buyer has placed an order, he is committed to the details given: the seller does not accept any responsibility for any errors in the delivery address provided, resulting in the non-delivery of goods.
Orders are not considered firm until the buyer has paid for them.
All our offers are only valid if there is stock available, without obligation and provided it has not been sold.
• ARTICLE 3 : DELIVERY AND RECEIPT
The Rums and Punchs are delivered in wooden cases or in cardboard boxes containing 1,2,3, or 6 bottles to be handed over in a single delivery at the same address.
Planetrum undertakes to deliver the goods in the shortest possible time. Average delivery times are detailed in product description, and may vary according to the country of destination selected by the customer.
Delivery will be made within the period forecasted directly to the address, or by means of notification if the client is absent.
Any possible delay does not give the buyer the right to cancel the sale, to reject the goods or to claim damages. Any delays resulting from war, uprisings, fire, strikes, accidents and the non-supplied products from the provider are considered to be due to circumstances outside one’s control, thereby releasing the seller from the obligation to make the delivery.
All liability for goods in transit corresponds to the address. Always check the packages on arrival. You have 48 hours to claim any damaged or missing goods from the shipping company.
• ARTICLE 4 : RETURN AND REFUND POLICY
If you are not 100% satisfied with your Planetrum purchase of a product, please email at sales@planetrum.com. You can either return your order for a full refund or exchange it for something else. You can return or exchange your purchase for up to 7 days from the purchase date. Returned or exchanged products must be in the condition you received them and in the original box and/or packaging.
Note: Planetrum recommends that you (1) use a carrier that offers shipment tracking for all returns and (2) either insure your package for safe return to Planetrum or declare the full value of the shipment so that you are completely protected if the shipment is lost or damaged in transit. If you choose not to (1) use a carrier that offers tracking or (2) insure or declare the full value of the product, you will be responsible for any loss or damage to the product during shipping.
• ARTICLE 5 : PRICES
Prices are given in EUROS and DOLLARS.
Prices given in product descriptions do not include shipping costs.
The price given in the Planetrum order confirmation is the final price, with all taxes and including VAT if it is relevant. This price includes the cost of the goods, maintenance, packing and storing as well as shipping.
• ARTICLE 6 : PAYMENT
Goods may be paid for by credit card,cheque, Bank tranfers or safe payment by Paypal.In the case of payment by cheque, this should be issued in Euros, once the order has been accepted by Planetrum. An invoice will be issued and sent to the address given by the client for invoices.
The Rums and Punchs remain the property of Planetrum until all corresponding outstanding amounts have been paid.
• ARTICLE 7 : LAWSUITS
All complaints and claims will be carefully dealt with, taking into account that the client is acting in good faith, because he/she has taken his time to expose his/her claims.
In the event of a lawsuit, the client will first inform the company, in an attempt to reach an amicable solution. Should this prove impossible, sole competence corresponds to the Pointe à Pitre (F.W.I) Trading Courts, regardless of the agreed delivery destination and means of payment.
• ARTICLE 8 : LEGAL INFORMATION
Alcohol abuse: Alcohol abuse damages your health. Learn to drink and appreciate alcohol in moderation.
Information Technology and your rights: In accordance with the French law 78-17 dated 6 January 1978; you are entitled to access and alter your personal details.
